Suburban Landscape Supply, Inc. is a Michigan based landscape supply company, located at: 960 Ladd Rd. Walled Lake, MI 48390. We provide bulk landscape supplies for pick up at our yard, or they can be delivered to you. Our products may be ordered online, in person, or over the phone by calling 248-960-4000.

Geographic Scope: Our Service, products, and deliveries are available to customers located within the United States only. We do not ship or deliver products internationally and do not process orders from outside the United States.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Product Availability and Pricing

All products are subject to availability. Suburban Landscape Supply, Inc. reserves the right to discontinue any product or limit quantities offered at any time without prior notice. While we strive to keep all product information and pricing accurate on our website, errors may occasionally occur. If a product is listed at an incorrect price or with inaccurate information, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and payment accepted. We will notify you as soon as possible if we are unable to fulfill your order and will issue a full refund of any amount charged. We are not obligated to honor pricing errors or to sell any product at an incorrect price, even after an order confirmation has been sent.

Delivery Policy:

• Because of the nature of delivering our products and the size of trucks and equipment required to make such deliveries, Suburban Landscape Supply, Inc. will deliver your order up to the street curb line in front of your home or business and wherever our driver feels is the safest location for the delivery of your order.
• Please see our requirement for a signed DELIVERY WAIVER for deliveries requested to be made above the street curb line.
• Please see our requirement for a signed TOPSOIL WAIVER for deliveries of Topsoil.

Delivery Fees:

• Delivery Rates are generated by zip code. View the list of Delivery Zones for a detailed list of our delivery fees.
• There’s an additional fee for deliveries of palletized materials (i.e; pavers, wall stone, flagstone, etc.), as they require a forklift to unload. See our Delivery Fees for these special rates.

Order Cancellation

Orders may be cancelled by the customer within 24 hours of placing the order at no charge. Cancellations requested more than 24 hours after the order was placed but before delivery has been scheduled may be subject to a cancellation fee of up to 25% of the order total to cover administrative and handling costs. Orders that have already been delivered cannot be cancelled; returns on delivered items are governed by our Returns Policy below. Suburban Landscape Supply, Inc. reserves the right to cancel any order due to product unavailability, pricing errors, or suspected fraudulent activity. In such cases, we will notify you as soon as possible and issue a full refund of any amount paid.

Returns Policy:

• No returns on un-banded (broken) Pallets.
• Return requests must be submitted within 7 days of delivery or pickup.
• There is a 35% restocking fee on all approved returns.
• There is a $35.00 return check fee.

Wholesale and Bulk Orders

Suburban Landscape Supply, Inc. offers wholesale pricing and special bulk ordering options for landscape contractors, builders, municipalities, and other business customers. Wholesale pricing and terms are available for qualified customers and may differ from standard retail pricing.

Wholesale customers are subject to all terms and conditions on this page, with the addition of any specific wholesale agreements negotiated separately. Volume discounts, delivery terms, and payment arrangements for wholesale orders may be customized based on order size, frequency, and customer relationship.

The Service and its original content, features and functionality are and will remain the exclusive property of Suburban Landscape Supply, Inc. and its licensors.

Termination

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Limitation of Liability

In no event shall Suburban Landscape Supply, Inc., its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the specific order giving rise to the claim.

You agree to indemnify, defend, and hold harmless Suburban Landscape Supply, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to (i) your violation of these Terms, (ii) your use of the Service, (iii) your violation of any rights of any other person or entity, or (iv) any damage or injury caused to any person, property, or vehicle arising from the installation or use of products purchased from Suburban Landscape Supply, Inc.

Force Majeure

Suburban Landscape Supply, Inc. shall not be liable for any failure or delay in performing its obligations under these Terms or in delivering products or services where such failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, weather events, natural disasters, fire, flood, earthquake, war, terrorism, civil unrest, government action, labor disputes, strikes, supply shortages, transportation disruptions, or failures of third-party services. In such events, we will make reasonable efforts to notify affected customers and to minimize the impact. Where applicable, we may reschedule deliveries or issue refunds as appropriate.

Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be addressed through good faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days of written notice, both parties agree to submit to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Oakland County, Michigan. The arbitrator’s decision shall be final and binding, and judgment may be entered upon the award in any court having jurisdiction. Nothing in this section shall prevent Suburban Landscape Supply, Inc. from seeking injunctive relief in a court of competent jurisdiction to protect its intellectual property, confidential information, or other proprietary rights.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Michigan without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice by posting a notice on this website and/or contacting you via the email address associated with your account prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
